1. GENERAL

1.1 The company Agnes Schorer, Bleibtreustrasse 34/35 10707 Berlin, Germany is the owner of the label AGNES NORDENHOLZ and operates an online-shop at the internet address www.agnesnordenholz.com

1.2 All orders placed via this website and all deliveries and services are subject to our present general terms and conditions in the relevant version at the order date. We do not admit deviating clauses unless we have agreed to their validity in writing.

2. IMPORTANT INFORMATION

2.1 The goods offered on www.agnesnordenholz.com are presented at the website as digital photographs of existing products. Slight differences between photographs and reality do not establish a defect of the ordered goods.

2.2 We continuously update the availability of our merchandise, therefore it normally corresponds to the effective stock in our warehouse. Nevertheless, please note that in exceptional cases goods presented on our website might no longer be available at the time of the customer’s visit to the website as well respective prices might have changed. In such improbable cases we inform the Customer by email no later than the next working day after the order date. All prices shown include the German VAT and exclude shipping costs. Delivery and shipping fees are stated separately during your order.

2.3. The online-shop www.agnesnordenholz.com is entitled to perform partial deliveries.

3. CONTRACT

3.1 By transmitting your order via our website to us you make a binding offer to enter into the contract. Transmitting your orders means that you have finalized the order by entering all requested information during the order process and sent the order form to us by clicking the “confirm order” button. The contract is entered only once we accept offer, or at latest when we send the product.

3.2 Agnes Schorer is entitled to reject orders without stating any reasons, especially if there is suspicion that the goods purchased on our website are to be sold to third parties commercially.

3.3 After receiving the order, Agnes Schorer will inform the customer via E-mail about the receipt of the order; for this, the E-Mail address the customer indicated in the order form will be used. This notification contains all customer and order details and can be printed out. This automatic order confirmation only documents the receipt of the order, and does not represent an acceptance of the offer, or a binding contract.

3.4 By pressing the “Confirm Order” button, the customer automatically saves the details of the order; these details can be viewed on the webpage using registration the customer created when placing the order.

4. DELIVERY AND SHIPPING

4.1. Depending on the country of destination the delivery of your order will be handled using well-proven company such as DHL or UPS.

4.2. We ship all to the address given to us by the customer.

4.3. We deliver to countries that are liable for customs duty within five to twelve working days after your product is ready for shipment. Delays resulting from the processing duration of the respective customs authority are not within our control. If you are outside the EU product prices are exclusive of all taxes and duties, as well as the German VAT. Please note that all custom taxes, duties, handling fees and import sales taxes have to be paid by the customer. All these fees vary widely from country to country, therefore we are not able to tell you what the cost would be. We recommend to contact your local customs office before you order, so you are not surprised by charges you were not expecting. Please note that we provide all required shipping documents as well as the cost for transportation insurance.

4.4 Agnes Schorer advises the customer, that all information on availability of the product, shipment and receipt are guidelines only. They do not constitute binding shipment or delivery dates.

5. PAYMENT

5.1 The payment of your order can be done by debiting your paypal-account. As soon as the payment reaches our account, we will ship the product to the customer.

5.2 Until full payment is done Agnes Schorer retains its title to the goods.

7. WARRANTY

7.1 Legal warranty regulations apply.

8. RETURNS POLICY

8.1 You may return merchandise within 14 days of receipt provided that the goods are sent to us by registered mail to our address below. The 14 days term starts on the day after you have received the goods together with this returns information. Reduced items (sale) are excluded from this right of return.

8.2 Only non-faulty goods which are in their original condition with all tags attached and in their original packaging will be accepted. Goods must be in the original, undamaged box and must be wrapped in an additional outer layer as the box is considered as part of the product. We are unable to accept items which have been worn, altered or washed. We strongly advise all customers to carefully check goods immediately upon receipt before removing any attached tags and before disposing of any original packaging. If the merchandise has lost value upon being returned to us, we can ask for a reimbursement for the lost value.

8.3 Before leaving our warehouse to you our goods undergo an accurate quality control check. Nevertheless there might occur the unlikely accident of dispatching a faulty item. Please inform our customer service team within 3 days of receipt by emailing to office@agnesnordenholz.com

10. CHOICE OF LAW, EFFECTIVENESS

10.1 German law applies. Place of performance is Berlin, Germany. The courts of Berlin, Germany shall have jurisdiction.

10.2 Should one or several regulations of these terms and conditions not be valid, this will not influence the effectiveness of the other regulations.
